Corp. of India‘The Supreme Court on Wednesday held a landmark hearing in the Krishna-Godavari basin gas migration case, one of the world’s biggest legal battles. During the hearing, Reliance Industries Ltd and its foreign subsidiaries expressed their willingness to take the mediation route to resolve the long-standing dispute with the central government. A bench headed by Chief Justice Surya Kant heard the case, j‘The bench consisted of Justice Jayamalya Bagchi and Justice Vipul M Panchalio.
During the proceedings, lawyers representing Reliance and its affiliates informed the bench that all the petitioners would send a formal letter to the Indian government on Wednesday. Through this letter they will request the government to initiate the mediation process. The companies requested the court to stay until the arbitration comes out with a clear outcome, Until then, the judicial hearing of this case should be postponed. However, Attorney General R Venkataramani, who appeared for the central government, vehemently opposed the companies’ claim. He informed the court that the hearing should continue at present and if there is any positive progress in the mediation between the government and the company., Then the government itself will inform the court.
After hearing arguments from both sides, the Supreme Court bench refused to adjourn the hearing for the time being. The court clarified that if the parties come to court after reaching an agreement through successful mediation, Then the case can be settled permanently. The bench observed, if a successful mediation is achieved through negotiation, So that is a very good thing‘b and then the court will close the case. Reliance Industries, BP Expl‘The petition was filed by Ration Alpha Limited and Nico Limited challenging the judgment of the Delhi High Court. On 15 February 2025, the Delhi High Court overturned the decision of the earlier single judge bench., which had earlier upheld the judgment of the International Arbitral Tribunal which had come in favor of Reliance and its subsidiaries.
The root cause of this entire controversy is the process of gas transfer or gas extraction from the Krishna-Godavari basin. The central government had alleged that Reliance and its subsidiaries had extracted gas from some of these reservoirs., which they had no legal right to use. The government demanded $1.55 billion in fines or compensation from the companies to compensate for the irregularities. However, in July 2018, the International Arbitral Tribunal dismissed the Indian government’s massive claim by a narrow majority. The tribunal ruled in favor of Reliance and its partners and ordered them to pay US$8.3 million in compensation to the government., Which was later challenged by the government in the High Court.
